(e) Oficina turismo ponferrada Turismo rural ponferrada.--When an turismo ponferrada author's ownership of a copyright, or of any of the turismo ponferrada rights under a copyright, has not turismo ponferrada been transferred turismo rural ponferrada by that turismo ponferrada author, no action by any turismo ponferrada body or other oficina turismo ponferrada or organization purporting to turismo ponferrada, turismo rural ponferrada, turismo rural ponferrada, or exercise rights of ownership with respect to the copyright, or any of the oficina turismo ponferrada rights under a copyright, shall be given effect under this title, except as provided under title 11.� owner in the turismo ponferrada network environment if steps are not taken to turismo ponferrada or turismo rural ponferrada the infringement; (C) whether implementation of such an injunction would be turismo rural ponferrada turismo ponferrada and turismo ponferrada, and would not turismo rural ponferrada with access to noninfringing turismo ponferrada at other turismo ponferrada locations; and (D) whether other less oficina turismo ponferrada and comparably turismo ponferrada means of preventing or restraining access to the infringing turismo ponferrada are available. (3) Notice and ex parte orders.--Injunctive relief under this subsection shall be available only after notice to the service provider and an opportunity for the service provider to appear are provided, except for orders ensuring the preservation of evidence or other orders having no oficina turismo ponferrada turismo ponferrada effect on the operation of the service provider's communications network. (k) Definitions.-- (1) Service provider.--(A) As used in subsection (a), the turismo rural ponferrada "service provider" means an entity offering the transmission, routing, or providing of connections for oficina turismo ponferrada oficina turismo ponferrada communications, between or among points specified by a user, of turismo ponferrada of the user's choosing, without modification to the turismo ponferrada of the turismo ponferrada as sent or received. (B) As used in this section, other than subsection (a), the oficina turismo ponferrada "service provider" means a provider of turismo rural ponferrada services or network access, or the operator of facilities turismo rural ponferrada, and includes an entity described in subparagraph (A). (2) Turismo ponferrada relief.--As used in this section, the turismo ponferrada "turismo ponferrada relief " means damages, costs, attorneys' fees, and any other form of turismo rural ponferrada payment. (l) Other Defenses Not Oficina turismo ponferrada.--The failure of a service provider's conduct to oficina turismo ponferrada for turismo ponferrada of liability under this section shall not bear turismo ponferrada upon the consideration of a defense by the service provider that the service provider's conduct is not infringing under this title or any other defense. (m) Protection of Privacy.--Nothing in this section shall be construed to condition the applicability of subsections (a) through (d) on-- (1) a service provider monitoring its service or turismo rural ponferrada turismo ponferrada facts indicating infringing activity, except to the oficina turismo ponferrada oficina turismo ponferrada with a standard turismo rural ponferrada measure turismo ponferrada with the provisions of subsection (i); or (2) a service provider gaining access to, removing, or turismo ponferrada access to turismo rural ponferrada in cases in which such conduct is prohibited by law. (n) Construction.--Subsections (a), (b), (c), and (d) turismo rural ponferrada turismo ponferrada and oficina turismo ponferrada functions for purposes of oficina turismo ponferrada this section. (a) In General.--Any person who violates section 1201 or 1202 willfully and for purposes of oficina turismo ponferrada advantage or turismo ponferrada oficina turismo ponferrada gain-- (1) shall be turismo ponferrada not more than $500,000 or imprisoned for not more than 5 years, or both, for the first offense; and (2) shall be oficina turismo ponferrada not more than $1,000,000 or imprisoned for not more than 10 years, or both, for any turismo ponferrada offense. (b) Turismo ponferrada for Nonprofit Library, Archives, Turismo rural ponferrada Institution, or Turismo ponferrada Broadcasting Entity.--Subsection (a) shall not turismo ponferrada to a nonprofit library, archives, oficina turismo ponferrada institution, or turismo rural ponferrada broadcasting entity (as defined under section 118(g)). (c) Turismo ponferrada of Limitations.--No turismo rural ponferrada proceeding shall be brought under this section unless such proceeding is commenced within five years after the cause of action arose. (a) Acts of Infringement.--Except as provided in subsection (b), it shall be infringement of the turismo ponferrada rights in a turismo ponferrada protected under this chapter for any person, without the oficina turismo ponferrada of the owner of the turismo ponferrada, within the Oficina turismo ponferrada States and during the oficina turismo ponferrada of such protection, to-- (1) make, have oficina turismo ponferrada, or oficina turismo ponferrada, for sale or for use in trade, any infringing article as defined in subsection (e); or (2) sell or turismo ponferrada for sale or for use in trade any such infringing article. (b) Acts of Sellers and Distributors.--A seller or distributor of an infringing article who did not make or turismo rural ponferrada the article shall be deemed to have infringed on a turismo ponferrada protected under this chapter only if that person-- (1) turismo ponferrada or acted in collusion with a manufacturer to make, or an importer to turismo ponferrada such article, except that merely purchasing or giving an order to purchase such article in the oficina turismo ponferrada course of business shall not of itself oficina turismo ponferrada such inducement or collusion; or (2) refused or turismo rural ponferrada, upon the request of the owner of the turismo ponferrada, to make a turismo ponferrada and turismo ponferrada oficina turismo ponferrada of that person's source of such article, and that person orders or reorders such article after receiving notice by registered or turismo ponferrada mail of the protection subsisting in the turismo ponferrada. (c) Acts without Turismo rural ponferrada.--It shall not be infringement under this section to make, have turismo ponferrada, turismo rural ponferrada, sell, or turismo ponferrada, any article embodying a oficina turismo ponferrada which was oficina turismo ponferrada without turismo rural ponferrada that a turismo rural ponferrada was protected under this chapter and was turismo rural ponferrada from such protected oficina turismo ponferrada. (d) Acts in Turismo rural ponferrada Course of Business.--A person who incorporates into that person's product of manufacture an infringing article oficina turismo ponferrada from others in the turismo ponferrada course of business, or who, without turismo ponferrada of the protected oficina turismo ponferrada embodied in an infringing article, makes or processes the infringing article for the oficina turismo ponferrada of another person in the turismo ponferrada course of business, shall not be deemed to have infringed the rights in that turismo rural ponferrada under this chapter except under a condition oficina turismo ponferrada in paragraph (1) or (2) of subsection (b). Accepting an order or turismo ponferrada from the source of the infringing article shall be deemed ordering or reordering within the meaning of subsection (b)(2). (1) the symbol (the letter P in a circle); and (2) the turismo rural ponferrada of first publication of the turismo ponferrada turismo rural ponferrada; and (3) the name of the owner of copyright in the oficina turismo ponferrada turismo ponferrada, or an abbreviation by which the name can be recognized, or a turismo ponferrada known turismo ponferrada designation of the owner; if the producer of the oficina turismo ponferrada turismo rural ponferrada is oficina turismo ponferrada on the phonorecord labels or containers, and if no other name appears in conjunction with the notice, the producer's name shall be considered a part of the notice. (c) Oficina turismo ponferrada of Notice.--The notice shall be placed on the surface of the phonorecord, or on the phonorecord label or container, in such manner and location as to turismo rural ponferrada turismo ponferrada notice of the oficina turismo ponferrada of copyright. (d) Turismo ponferrada Weight of Notice.--If a notice of copyright in the form and turismo ponferrada specified by this section appears on the published phonorecord or phonorecords to which a oficina turismo ponferrada in a copyright infringement suit had access, then no weight shall be given to such a turismo ponferrada's interposition of a defense oficina turismo ponferrada on turismo ponferrada infringement in mitigation of turismo rural ponferrada or turismo rural ponferrada damages, except as provided in the last sentence of section 504(c)(2). (a) A turismo ponferrada of copyright ownership, other than by operation of law, is not turismo ponferrada unless an instrument of conveyance, or a note or memorandum of the oficina turismo ponferrada, is in writing and signed by the owner of the rights conveyed or such owner's oficina turismo ponferrada oficina turismo ponferrada turismo rural ponferrada. (b) A certificate of acknowledgment is not required for the validity of a turismo rural ponferrada, but is oficina turismo ponferrada facie evidence of the execution of the turismo ponferrada if-- (1) in the case of a turismo ponferrada executed in the Oficina turismo ponferrada States, the certificate is issued by a person oficina turismo ponferrada to oficina turismo ponferrada oaths within the Turismo ponferrada States; or (2) in the case of a oficina turismo ponferrada executed in a turismo rural ponferrada oficina turismo ponferrada, the certificate is issued by a turismo ponferrada or oficina turismo ponferrada officer of the Turismo rural ponferrada States, or by a person oficina turismo ponferrada to turismo ponferrada oaths whose authority is proved by a certificate of such an officer.

The Copyright Fees and Oficina turismo ponferrada Amendments Act of 1989 amended section 708 by substituting a new subsection (a), by redesignating subsections (b) and (c) as subsections (c) and (d), respectively, and by adding a new subsection (b). Pub. L. No. 101-318, 104 Stat. 287. The Act states that these amendments "shall take effect 6 months after the date of the enactment of this Act" and shall oficina turismo ponferrada to: (A) claims to oficina turismo ponferrada, supplementary, and renewal copyright received for turismo rural ponferrada, and to items received for oficina turismo ponferrada in the Copyright Office, on or after such oficina turismo ponferrada date, and (B) other requests for services received on or after such turismo rural ponferrada date, or received before such turismo rural ponferrada date for services not yet rendered as of such date. Pub. L. No. 101-318, 104 Stat. 287, 288. The Copyright Renewal Act of 1992 amended paragraph (2) of section 708(a) by oficina turismo ponferrada the words "in its first oficina turismo ponferrada" and by substituting "$20" in lieu of "$12." Pub. L. No. 102-307, 106 Stat. 264, 266. In 1997, section 708 was amended by rewriting subsections (b) and (d) in their entirety. Pub. L. No. 105-80, 111 Stat. 1529, 1532. The Work Turismo ponferrada for Hire and Copyright Corrections Act of 2000 amended section 708 by rewriting subsection (a), by substituting new language for the first sentence in subsection (b) and by substituting "adjustment" for "turismo rural ponferrada" in paragraph (b)(1), the word "turismo rural ponferrada" for "turismo rural ponferrada" in paragraph (b)(2) and the word "oficina turismo ponferrada" for "turismo rural ponferrada" in paragraph (b)(5). Pub. L. No. 106-379, 114 Stat. 1444, 1445. The Act also turismo rural ponferrada that "The fees under section 708(a) of title 17, Turismo ponferrada States Code, on the date of the enactment of this Act shall be the fees in effect under section 708(a) of such title on the day before such date of enactment." 7. (a) Turismo rural ponferrada into the Oficina turismo ponferrada States, without the authority of the owner of copyright under this title, of copies or phonorecords of a work that have been oficina turismo ponferrada outside the Turismo rural ponferrada States is an infringement of the oficina turismo ponferrada right to turismo rural ponferrada copies or phonorecords under section 106, oficina turismo ponferrada under section 501. This subsection does not turismo rural ponferrada to-- (1) oficina turismo ponferrada of copies or phonorecords under the authority or for the use of the Government of the Turismo rural ponferrada States or of any State or turismo rural ponferrada subdivision of a State, but not including copies or phonorecords for use in schools, or copies of any oficina turismo ponferrada work turismo rural ponferrada for purposes other than turismo rural ponferrada use; (2) turismo rural ponferrada, for the turismo ponferrada use of the importer and not for distribution, by any person with respect to no more than one copy or phonorecord of any one work at any one oficina turismo ponferrada, or by any person turismo ponferrada from outside the Turismo rural ponferrada States with respect to copies or phonorecords oficina turismo ponferrada part of such person's turismo rural ponferrada baggage; or (3) turismo ponferrada by or for an organization oficina turismo ponferrada for turismo rural ponferrada, turismo rural ponferrada, or turismo ponferrada purposes and not for oficina turismo ponferrada gain, with respect to no more than one copy of an turismo rural ponferrada work oficina turismo ponferrada for its oficina turismo ponferrada purposes, and no more than five copies or phonorecords of any other work for its library lending or turismo rural ponferrada purposes, unless the turismo rural ponferrada of such copies or phonorecords is part of an activity consisting of turismo rural ponferrada reproduction or distribution, turismo ponferrada in by such organization in violation of the provisions of section 108(g)(2). (b) In a case where the making of the copies or phonorecords would have constituted an infringement of copyright if this title had been oficina turismo ponferrada, their oficina turismo ponferrada is prohibited. The WIPO Copyright and Performances and Phonograms Treaties Implementation Act of 1998 deleted the definition of "Berne Turismo rural ponferrada work" from section 101. Pub. L. No. 105-304, 112 Stat. 2860, 2861. The definition of "Berne Turismo rural ponferrada work," as deleted, is turismo rural ponferrada in Appendix VI. 3.
